We respect your privacy. This Privacy Policy describes how Livvie B.V. (“Livvie”, “we”, “us”, “our”) collects, uses, discloses, and protects your information when you use the software and related services provided or operated by Livvie, including any functionalities, content, communications, websites, and other media (collectively, the “Service”), and subsequent updates of the Service. 

Please read this Privacy Policy carefully before you start using the Service. If you do not agree with the terms of this Privacy Policy, do not use or access the Service.

1. Collection of information

We collect multiple types of information about you in when you provide information to us, you use the Service, or we obtain it from third parties.

Information you provide to us

When you create an account, you provide personally identifiable information, which may include your first name, last name, date of birth, country of residence, email address, and organisation name. When you use a paid service, we (or a payment processor) may also collect a tax identifier, billing address, and payment information.

As you use the Service, you may provide information about your preferences, diet, or business initiatives. We also collect messages you send to us such as comments, feedback, support requests, or other inquiries, that may contain personal information. This includes messages you send to us via the software, email, website, or social media.

You are not obligated to provide us with personal or other information. If you choose not to provide us with certain information, you may not be able to access or use parts of the Service.

Information collected by using the Service

When you use the Service, we automatically collect or generate information about you and your usage. This information includes which functionalities you use, links you click, and pages you visit. We also collect information about the device and connection you use to access the Service, including information about your operating system, device identifiers, internet browser, Internet Protocol (IP) address, approximate location, domain names, referring or exit URLs, date and time of usage, and diagnostic data.

We (and third party partners) use cookies and other tracking technologies (such as web beacons) in the Service to collect and store information. 2. Use of your information

We use your information for the following purposes.

  • To provide, maintain, and protect the Service. This includes the creation and management of your account, operating and maintaining the Service, addressing or preventing service, security, or technical issues, and providing access to your data.
  • To personalise the Service according to your usage and avoid that you have to re-enter information or re-configure settings.
  • To optimise the Service by analysing aggregated usage data and communications such as surveys, feedback, and feature requests.
  • To communicate with you about the Service, including responding to support requests, comments or questions, subscription purchases and expiration dates, software updates or notices, and other administrative messages.
  • To promote and drive engagement with the Service by communicating with you about surveys, promotions, new features, newsletters, and other communications we think may be of interest to you based on information about you and how you use the Service. You may opt out of these communications as described below.
  • To resolve errors and troubleshoot support requests.
  • For analytics on aggregated data entries and usage data.

  • We share information with third parties to provide, maintain, improve, support, and market the Service. This includes service providers for development, hosting, maintenance, storage, security, support, authentication, payment processing, billing, analytics, email, marketing, advertisement, and other services.
  • With your consent, we may share your information on public channels, such as for the publication of testimonials and reviews.
  • We may publicly share analytical results of aggregated, anonymised data entries and usage data.
  • You may choose to share your information, content, and invitations to use the Service with others through public channels such as social media.
  • Authorised users from your organisation may view and, if applicable, edit your information, including your name, email address, billing information, account settings, business initiative data, and other data entries.
  • In case of a merger, acquisition, bankruptcy, or any reorganisation of Livvie, we may transfer your information.
  • We may share your information with authorities if required to support law enforcement and regulators.
  • We may share your information to detect, investigate, prevent, and respond to activity that may violate the Terms of Service or Privacy Policy.

We do not sell your information to third parties as a data broker. However, note that certain laws may consider tracking technologies used for targeted advertising as “selling”. Third party services are not controlled by Livvie and not governed by this Privacy Policy. We recommend that you familiarise yourself with the terms and policies of third parties.

4. International transfer of your information

The information we collect through the Service may be transferred, stored, and processed in multiple countries by us, our affiliates, and third party service providers. Your information may be transferred outside of your country of residence and stored or processed in a country that has data protection laws different from your jurisdiction. We take steps to protect your information according to applicable laws.

By using the Service, you acknowledge and agree that your information is transferred, disclosed, and used in countries where we, our affiliates, and third party service providers maintain facilities and resources.

5. Security of your information

We care about the security of your information, and we use commercially acceptable and reasonable means to protect your information. However, please be aware that no security measure, storage, or data transmission is perfectly secure or impenetrable. Livvie can therefore not guarantee or ensure that information you transmit or store through the Service is absolutely protected from access, alteration, or destruction.

6. Links to third parties

The Service may contain links to third party websites and services, including links from advertisements. If you follow such a link, any interactions and information you provide on third party services are not covered by this Privacy Policy. Livvie has no control over, nor responsibility for the information collected by third parties or the content of third party privacy policies and practices. We recommend that you inform yourself of the privacy policy and terms of any third party service before visiting or providing your information.

7. Data retention

We retain your data for as long as necessary to carry out the business purposes as defined in the Terms of Service and this Privacy Policy, or as required by applicable law. When your account is deactivated, we retain your information for a commercially reasonable period to enable re-activation of the Service. If your account is part of an organisation that continues to use the Service, then we retain information that allows the organisation to continue to use the Service. We may retain certain information as needed to comply with legal and audit obligations, resolve disputes, enforce agreements, and for legitimate business interests.

8. Children policy

We do not knowingly market or provide the Service to children under the age of 13 years, nor solicit information from children under the age of 13 years. If you are aware of any personal information that may be collected through the Service from children under the age of 13 years, please contact Livvie at hello@livvie.co to initiate appropriate action.

9. Choices regarding your information

Depending on your jurisdiction, you may have certain rights regarding your information, including rights granted under the European Union and United Kingdom General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). You can request to exercise your rights according to below procedures, as required and permitted by applicable law and regulations.   • You may access and edit information you provided to us via the Service and software settings. You may also request access to and correction of your information by contacting us.
  • If you deactivate your account, we may retain your information. If you want to delete your information, please refer to the instructions below.
  • You may delete your account and certain information through settings within the Service. Alternatively, you may request us to delete your account and information. Please be aware that we may retain certain information, for example as aggregated and anonymised data or to comply with legal obligations.
  • You may request to stop accessing, storing, analysing, or otherwise processing your information.
  • You may withdraw consent you provided us for using your information. If you withdraw consent, this does not affect the lawfulness of any processing that has already taken place.
  • You may request the transfer of certain information you have provided to us in an electronic format, if applicable.
  • You may opt out of receiving marketing messages through your settings, by clicking an unsubscribe link in an email, or contacting us. You cannot opt out of service communications.
  • You may opt out of cookies and other tracking technologies through your browser and for our website via the cookie notice and cookie policy. Please refer to your device and browser to delete cookies and other tracking technologies. Note that disabling cookies and other tracking technologies may impact your user experience and limit you from accessing or using parts of the Service.
  • You may opt out of sharing your information to display targeted advertisements through your browser and for our website via the cookie notice and cookie policy.
  • You may request information about how we process your information.
  • You may object to the processing of your information for marketing and profiling purposes.

10. California privacy rights

If you are a resident of California, the CCPA grants you specific rights. This Privacy Policy describes the procedures to exercise your rights, including requesting information about how we process your information, how you can access, correct, and delete your information, and how you can opt out of the processing and sharing of certain information. We do not sell your information to third parties but note that tracking technologies used for targeted advertising can be considered as “selling”. We do not willingly or knowingly collect information from California residents who are 16 years or younger.

As a California resident, you have the additional right to request information about categories of personal information we collected, the sources from which personal information is collected, and the third parties with whom we shared your information in the past 12 months. We will not discriminate against you for exercising your privacy rights under the CCPA.
